TERMS & CONDITIONS

INTRODUCTION

By accessing or using this website, purchasing an item from the shop, submitting a commission request, or uploading content, you agree to these Terms & Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

SHOP ORDERS

  • Product descriptions, prices, availability, and images may be changed or corrected at any time.

  • Colors may appear differently depending on your screen or device. Minor differences between online images and the final physical product are not defects.

  • Orders are subject to acceptance. I may cancel or refuse an order where permitted by law, including for suspected fraud, pricing errors, or unavailable stock.

  • You are responsible for providing accurate order, shipping, and contact information.

  • Shipping times are estimates, not guarantees. I am not responsible for delays caused by carriers, customs, incorrect addresses, or events outside my reasonable control.

  • Any customs duties, import taxes, or similar charges are the customer’s responsibility unless stated otherwise.

  • All sales are final. No refunds will be provided. No exchanges or cancellations.

COMMISSIONS

The terms and conditions regarding commissions is located within the FAQs section of this website. It is your responsibility to review and understand these terms prior to submitting the interest form and submitting photos for use. All interest forms require acknowledgement and a digital signature indicating your compliance with the terms for the duration of the project.

PHOTOS AND REFERENCE UPLOADS

Photos and other materials you upload for a commission are used only as reasonably necessary to evaluate, communicate about, and create the requested work, plus limited recordkeeping, backup, and legal purposes.

Please do not send sensitive personal information that is not needed for your request. If you provide a photo of another person, including a child, you are responsible for ensuring you have appropriate permission to provide it.

If you upload or send photos, images, text, or other reference materials (“Client Content”) for a commission, you confirm that:

​

  • You own the content or have all necessary permission, consent, and rights to provide it to me and allow me to use it for the commission.

  • If content shows another person, you have that person’s permission to use the image for this purpose.

  • If content includes a child or other minor, you are that child’s parent, legal guardian, or otherwise authorized to provide the image and permission for its use.

  • Your content does not violate anyone’s privacy, publicity, copyright, trademark, or other legal rights.

  • You will not upload highly sensitive information, such as government ID numbers, financial-account details, medical records, passwords, or private information that is not necessary for the commission.

  • You keep ownership of your Client Content. You grant me a limited, non-exclusive license to store, review, edit, and use it only as reasonably necessary to communicate about and create your requested commission, and to maintain ordinary business records.

  • I may delete Client Content after the commission is completed, except where retention is reasonably necessary for backups, legal obligations, dispute resolution, accounting, or recordkeeping. Please keep your own copies of all reference materials.

ARTWORK, COPYRIGHT, PERMITTED USE

All copyright rights are reserved.  Unless I expressly agree otherwise in a signed written agreement:

  • I retain all copyrights and other intellectual-property rights in my artwork, including original artwork, sketches, concepts, drafts, commission work, website content, photographs, product designs, and digital files.

  • Buying a physical product transfers ownership of that individual physical item only. It does not transfer copyright, reproduction rights, commercial rights, or rights to create derivative works.

  • Upon full payment for a personal commission, the client receives a limited, non-exclusive, non-transferable license to display the final commissioned artwork for personal, non-commercial use only.

  • You may not reproduce, trace, scan, copy, distribute, sell, license, alter, remove signatures or watermarks from, train artificial-intelligence systems on, mint as an NFT, or otherwise commercially use my artwork without my prior written permission.

  • Commercial use, including use in advertising, merchandise, publishing, branding, streaming, business materials, or products for sale, requires a separate written commercial license and may require additional fees.

  • I may display commissioned artwork, including approved work-in-progress images, in my portfolio, website, social media, exhibitions, promotional materials, and professional submissions, unless we agree otherwise in writing.

  • No copyright assignment, work-made-for-hire arrangement, or exclusive license is created unless clearly stated in a separate written agreement signed by me.

 

WEBSITE CONTENT

The content on this website—including artwork, text, graphics, logos, product images, and designs—is owned by or licensed to staniiicka and is protected by applicable intellectual-property laws.

You may view the website for personal, non-commercial use. You may not copy, reproduce, republish, distribute, scrape, or exploit website content without prior written permission.

USER CONDUCT

You agree not to:

  • use the website for unlawful, fraudulent, abusive, or harmful purposes;

  • interfere with the website’s security or operation;

  • upload malicious code, spam, or content that infringes another person’s rights;

  • impersonate another person or misrepresent your identity; or

  • attempt to gain unauthorized access to accounts, systems, or data.​

THIRD-PARTY SERVICES

The website may use third-party providers for services such as payment processing, order fulfillment, shipping, website hosting, analytics, email, or social-media integrations. Your use of those services may also be subject to their own terms and privacy policies.

DISCLAIMER AND LIMITATION OF LIABILITY

The website and its content are provided on an “as is” and “as available” basis, to the extent permitted by law. I do not guarantee that the website will always be available, error-free, secure, or free of harmful components.

To the maximum extent allowed by law, staniiicka will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, shop, or commission services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

GOVERNING LAW

These Terms are governed by the laws of New York State, without regard to conflict-of-law rules. Any dispute will be handled in the courts located in Saratoga County, NY, unless applicable law requires otherwise.​

CHANGES TO THESE TERMS

I may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the website after an update means you accept the revised Terms.​​
